AUTO PAY TERMS & CONDITIONS ENROLLMENT AGREEMENT
Effective Date: March 18, 2025
DO NOT PROCEED WITH THIS ENROLLMENT BEFORE YOU READ THE TERMS & CONDITIONS OF THE PROGRAM (“Terms & Conditions”) BELOW.
1. INTRODUCTION This Auto Pay Terms & Conditions Enrollment program (“Program“) outlines the terms under which you (“Customer”) authorize Cozzini Bros., Inc. (“Cozzini”) to automatically withdraw payments from your designated payment method for recurring charges related to the services provided by the Company.
2. AUTHORIZATION FOR AUTO PAY By enrolling in the Program you authorize Cozzini to:
- Automatically debit your designated bank account or charge your credit/debit card for amounts due on each billing cycle.
- Continue these payments unless and until you cancel Auto Pay in accordance with the terms outlined in this Agreement.
3. BILLING AND PAYMENT TERMS
- Auto Pay transactions will be processed on or after the delivery date of services.
- You agree to maintain sufficient funds in your designated account to cover the scheduled payments.
- If any payment for Services is rejected by Customer’s bank, credit card issuer, or other financial institution (a “Dishonored Payment”), Customer shall remain liable to Cozzini for such amount, and Cozzini reserves the right to charge any applicable fees as outlined in the Company’s policies.
- The Company is not responsible for any overdraft fees, insufficient fund fees, or penalties imposed by your financial institution.
- If a payment for any Services is dishonored because of insufficient funds, then Cozzini shall notify Customer to update its Customer Account to designate a valid payment method.
- The Customer Account shall be charged on the third (3rd) day of the following month (and each month thereafter) until such Dishonored Payment is paid in full.
- If a payment for any Services is dishonored because Customer no longer desires to participate in the Program, Customer must contact Cozzini customer service to dispute such payment and withdraw from the Program.
4. CANCELLATION AND MODIFICATION
- You may cancel or modify your Auto Pay enrollment at any time by contacting Cozzini Customer Service before the next scheduled payment date.
- Cancellation or modification requests can be submitted via email/online portal/customer service.

- Cozzini reserves the right to terminate Auto Pay enrollment at its discretion.
5. CHANGES TO TERMS
- The Company may modify this Agreement at any time and will provide prior notice of any significant changes.
- Cozzini will notify Customer of any changes in services provided or service rates, including any price increases. Changes may shall be clearly displayed on all invoices and in compliance with applicable law.
- Continued participation in Auto Pay after such modifications constitutes acceptance of the updated terms.
6. PRIVACY AND SECURITY
- Your payment information will be tokenized and encrypted and used only for processing payments in accordance with this Agreement.
- The Company complies with applicable data security standards to protect your financial information.
7. ACCEPTANCE OF TERMS
- By enrolling in AutoPay, the Customer affirms that they have thoroughly read, understood, and willingly accepted the Terms and Conditions as explicitly outlined above.
- The Customer authorizes Cozzini to charge the Customer Account as payment for all services and products provided by Cozzini to Customer (the “Services”) during each delivery cycle.
- This certification serves as an explicit acknowledgment by the Customer of their understanding and agreement with the stipulations and obligations laid out in these Terms and Conditions. It highlights Customer’s informed consent and signifies the Customer’s commitment to adhering to these guidelines and provisions (and all other terms, conditions and rules that Cozzini may implement, from time to time) throughout its enrollment in the Program.
- By enrolling in the Program, Customer consents to receive electronic confirmation of Customer’s enrollment and subsequent communications regarding the Customer Account via email.
